法國反對同意年齡法案請願

法國反對最低同意年齡法案請願（英：French petition against age of consent laws），為1977年遞交至法國議會的一份請願書。該請願書標題為《關於修訂針對未成年人的性犯罪法的公開信》。（法：Lettre ouverte sur la révision de la loi sur les délits sexuels concernant les mineurs）信中提議將成年人與15歲（當時法國的最低合法性行為年齡）以下未成年人之間的自願性行為合法化。共有69名知識分子、醫生及心理學家簽字，其中包括米歇爾·福柯、路易·阿拉貢、讓-保羅·薩特、雅克·德里達、羅蘭·巴特、西蒙·德·波娃、阿蘭·羅伯-格里耶、讓-弗朗索瓦·利奧塔等。^[1]

事件經過[編輯]

1977年1月26日，該請願書被發表至法國的世界報上。當天正是對三名涉嫌與13至14歲未成年男女性行為犯人審判的開庭時間。信中譴責了警方對他們判刑的行為。^[2]認為他們作為罪犯的資格與所被譴責的行為之間有不均衡，並認為若13歲的法國女性有權接受避孕藥，便應當有權利和能力同意性行為。^[2] 1978年4月4日，在廣播「法國文化」主催的談話節目中，福柯、讓·戴奈特（Jean Danet）、酷兒理論研究家蓋伊·霍奎恩（Guy Hocquenghem）同其他人，以談話的方式再次闡明了為何反對最低年齡法案。他們認為，當代社會正在塑造着「危險的個人」（figure of the individual dangerous to society），這一形向將會使社會從懲罰罪犯變為監禁罪犯，最終將會進入到一個「危險的社會」（society of dangers）。^[3]並同時指出，當今最低同意年齡法案類似一種契約法案，然而着本身是一種「陷阱」，因為人們在進行性行為前並不需要契約。^[3]這一對話後來被整理出版，名為《兒童性行為的危險性》（The Danger of Child Sexuality）。^[4]

爭議[編輯]

隨着20世紀末及21世紀初被報道的兒童性侵案件的增加，許多學者對這一請願的可行性提出了強烈的質疑。心理學家穆里爾·薩爾莫納（Muriel Salmona）認為這一舉動「完全缺乏社會常識」，認為兒童永遠是「性侵者的第一目標，是脆弱且無助的」。^[5]諸如福柯等學者則對兒童感受提出質疑，福柯認為，「事先假設兒童完全不能解釋並給予同意的資格本身也不可接受」。^[6]
